These Terms of Use (“Terms”) are a legal agreement between you and sparq. By downloading, accessing, or using the sparq app (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
The Service is operated by Quintus Kilsdonk (“sparq”, “we”, “us”). You can reach us at support@sparqdating.app.
You must be at least 18 years old to use sparq. By using the Service you represent and warrant that you are 18 or older, that the information you provide (including your date of birth) is accurate, and that you have the legal capacity to enter into these Terms. Accounts found to belong to anyone under 18 will be removed.
sparq is a proximity-based dating app. It uses your device's Bluetooth to detect when another sparq user is physically nearby and, where both people opt in, lets you form a time-limited match and chat so you can choose to meet in person. The Service does not use GPS or precise location. Detection over Bluetooth is intermittent and best-effort; we do not guarantee that any particular nearby user will be detected, that a match will form, or that the Service will be available without interruption.
sparq creates an anonymous account for you; no email or password is required. You are responsible for the content of your profile and for your activity in the app. You agree that the information you provide is truthful and that any photos you upload depict you and are ones you have the right to use.
You agree that you will not:
We operate a zero-tolerance policy toward objectionable content and abusive behaviour.
You retain ownership of the content you submit (such as your profile text and photos). You grant us a limited, non-exclusive, royalty-free licence to host, store, display, and transmit that content as necessary to operate the Service (for example, to show your profile to nearby users and deliver your messages). You are solely responsible for the content you provide and the consequences of sharing it.
You can block another user and report objectionable content or behaviour from within the app. Reports are reviewed and may result in removal of content and suspension or termination of accounts. We may remove content, limit visibility, or suspend or terminate any account at any time, with or without notice, where we believe these Terms have been violated or to protect users or the Service. You may stop using the Service and delete your account and data at any time using Reset account in the app.
With your permission, sparq sends push notifications (for example, about nearby people, likes, matches, and messages). You can control or disable these in the app's settings and in your device settings.
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that it will detect nearby users or produce matches.
To the fullest extent permitted by law, sparq will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service, or your interactions with other users, whether based on warranty, contract, tort, or any other legal theory. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold sparq harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your interactions with other users, or your violation of these Terms or of any law or the rights of a third party.
We may modify or discontinue the Service, or update these Terms, at any time. When we make material changes to these Terms we will revise the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules, and the courts of the Netherlands will have jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.
